The Oyo State High Court sitting in Ogbomoso has ordered a stay of execution of its earlier judgement on the Soun of Ogbomosoland kingship tussle between Prince Mohammed Kabir Olaoye versus the Executive Governor of Oyo state, Engineer Seyi Makinde, Oba Ghandi Afolabi Olaoye and others.

In its ruling on October 25, 2023, the Court faulted the process that led to the emergence of Prince Ghandi Olaoye as Soun of Ogbomosoland and thereby ordered a fresh selection process.

The defendants in the suit, including the Executive Governor of Oyo state, Oba Laoye and others, headed for the Appeal Court sitting in Ibadan to challenge the lower court’s ruling.

The case is still pending at the Appeal court.

However, while the case is yet to be decided at the Appellate court, the Applicant filed a fresh motion seeking for the stay of the Execution of the lower court.

In his ruling on Monday, 27th November 2023, Justice Kareem Adeyimika Adedokun granted the prayers of the applicants for the stay of the Execution of the judgement of the lower court

The orders granted are as follows; ” An order is hereby made staying the execution of the judgement of this Honourable court delivered on the 25th day of October 2023 in suit No HOG/27/2023 between Prince Mohammed Kabir Olaoye Vs Executive Governor of Oyo state and others pending the hearing and determination of the Appeal lodged by the 1st-3rd defendants/Applicants at the Court of Appeal, Ibadan Judicial Division.

“Also an order is also made by this Honourable court restraining the Claimant/Respondent by Himself or through his servants, agents, privies or otherwise whosoever described from taking any step or further step in recognition or in pursuance of the judgement of this Honourable court delivered on the 25th October 2023 in the suit No HOG/27/2023 between Prince Mohammed Kabir Olaoye Vs Executive Governor of Oyo state and others.”
