He said that they got married in 2005 under the Tiv Native Law and Custom and later wedded in 2015 and the marriage had been blessed with three children: two boys and a girl.

He said that his wife, the respondent, had refused to fulfill her marital duties such as taking care of the kids and conjugal responsibilities to him; the petitioner.

He said that she denied him sex between 2019 and 2021 when they ceased to cohabit.

“The respondent who is a Civil Servant with the Benue State with official closing hours of 4.00p.m. has since become intolerable to live with.

“She has the habit of abandoning her matrimonial home, always returning home very late in the night and has refused to heed to the countless counsel from the petitioner.

“She no longer takes care of the kids due to her keeping late nights and refused to show up at the hospital when our last child was operated upon in 2018,” he said.

Sunday said that they had several issues between 2005 and 2015 adding that on three of such occasions, she ran to her father’s house and stayed for a long time.

However, when the case came up, Linda, the respondent;said she was not liable to the allegations.

The magistrate, Mrs Dooshima Ikpambese, urged the parties to try and settle out of court and adjourned the case until Sept. 28 for hearing.
