Justice James Omotosho set the date on Thursday following oral arguments from legal representatives.

The lawsuit, brought forward by the non-governmental organization Break the Silence Foundation, seeks a court order of mandamus to compel the Inspector-General of Police and the Lagos State Police Command to reopen the inquiry into the musician’s passing.

During the proceedings, the court noted that neither the police authorities nor the other named respondents were represented by counsel.

The foundation’s legal team argued that the initial police investigation was insufficient and failed to adequately examine several critical leads or individuals who were among the last people to see the artist alive.

The court also addressed a motion from an individual, Samson Obaboye, who attempted to join the case as an interested party. Justice Omotosho dismissed this application, ruling that the applicant failed to demonstrate a sufficient legal interest to warrant his involvement in the proceedings.

Legal counsel for the foundation emphasized that their goal is to ensure transparency and accountability, citing continued public concern over the mysterious circumstances of the death.

Mohbad passed away on September 12, 2023, at the age of 27, triggering widespread public outcry. Although his remains were exhumed for an autopsy, the findings have not satisfied all parties, and the artist’s remains have yet to be laid to rest.

In February 2025, a Magistrate Court in Yaba, Lagos, previously cleared several individuals, including Naira Marley and Sam Larry, of involvement in the death after legal advice indicated no evidence linked them to the incident.
