A Federal High Court sitting in Abuja has ordered the Nigerian Police Force as well as the Inspector-General of Police, Mr. Kayode Egbetokun not to go near the building which occupies Nestoil Group on No. 41/42 Akin Ademola Street, Victoria Island in Lagos State as it belongs to Drawcok Estates LTD.
Drawcok Estates LTD had on November 7, 2025 through Mr. Kehinde Ogunwumiu, SAN, Ademola Abimbola, SAN with Esther Longe and Uchechi Chibueze prayed to the court to order the Nigerian Police Force and the IGP who are the first and second respondents not to interfere with or impend or violate her (applicant) right to own the properties on No. 4 Nyasa close, plot 19, Off Ontaria crescent /Mississippi road, Maitama Abuja and 41/42 Akin Adesola Street, Victoria Island, Lagos State as guarantees by the chapter 4 of the Constitution of the Federal Republic of Nigeria 1999 as amended as it only relates to the complaint litigated in the suit.
Delivering the judgement in suit number FHC/ABJ/CS/2385/2025 on November 24, 2025, the presiding judge, Honourable Justice R.N. Ofili Ajumogobia ruled that that the applicant has a right to own and possess her properties as mentioned in the addresses above as guaranteed by the 34 Constitution of the Federal Republic of Nigeria, 1999 as amended and the African Charter on Human and People’s Rights.
Justice Ajumogobia stressed further in her ruling that the sealing-off and occupation of the applicant’s properties on the addresses mentioned above by the Respondents constitute an infringement on the right of the applicant to own property, as guaranteed by Sections 43 and 44 of the he Constitution of the Federal Republic of Nigeria, 1999 as amended.
The judge also ruled that the Respondents, whether by themselves , their agents, agencies and servants, acting for it through them or any other person(s) howsoever described or claiming through them, to vacate the applicant’s properties on the addresses mentioned above, and deliver possession over to the applicant forthwith.
Ajumogobia stressed that the Respondents, whether by themselves, their agents, agencies, and servants, acting for or through them or any other person(s) howsoever described or claiming through them, to provide security for the applicant to take back possession of her properties on the addresses mentioned above.
She also gave an order that the Respondents is restrain, whether by themselves, their agents, agencies and servants, acting for or through them or any other person(s) howsoever described or claiming through them, from harassing the applicant and refusing her access to her properties on the addresses mentioned above.
