A lawsuit filed by the Peoples Democratic Party (PDP), challenging a federal high court judgment which nullified the election of Dauda Lawal as the Zamfara governorship candidate, has been struck out by a court of appeal.
A federal high court had nullified an earlier judgement which asked the party to carry out another primary.
It also barred the party from fielding any candidate for the 2023 governorship election after aspirants, Ibrahim Shehu and Hafiz Nahuche who scored one vote each in the primary alleged that there were anomalies, contradictions, fraud, and violation of the electoral act and the party’s constitution, among other issues.
Justice Lawal Shu’aibu of the court of appeal in Sokoto, who presided over the case on Wednesday, November 23, dismissed PDP’s appeal against the judgement on grounds of lacking merit.
He said the appeal suit is a mere academic exercise since the appellants participated in the rerun primary after the initial primary was nullified.
Shu’aibu who also noted that the participation of the appellants in the fresh primary election, testimonies of witnesses and documents submitted as exhibits depict that they agreed to the violation of electoral acts as well as PDP guidelines, ruled that the appellants had no right to appeal the judgment.
He also awarded N100,000 against the appellants.
