The Court of Appeal sitting in Abuja has set aside the judgment of the National and State House of Assembly Election Tribunal in Asaba, Delta State.
Recalls that the tribunal had declared Ndudi Elumelu, candidate of the Peoples Democratic Party (PDP), as winner of the 2023 election for Aniocha/Oshimili Federal Constituency of Delta State.
However, the appellate court in a ruling on Thursday affirmed Ngozi Okolie, candidate of the Labour Party (LP), as the duly elected lawmaker.
The Appeal Court faulted the tribunal for voiding Okolie’s election and dismissed the petition filed by Elumelu before the trial tribunal on which the voided judgment was given.
The court agreed with the lawyer to the Labour Party, Mahmud Magaji, that Okolie was duly nominated, sponsored by his party contrary to the position of the Tribunal.
Mr. Mahmud had argued that his client was duly nominated and sponsored by LP, adding that he resigned his appointment as a Senior Special Assistant (SSA) to Delta State Government as required by the constitution.
